THIS AGREEMENT is between House of Chess shop (PTY) Ltd (referred to as "us", "our" or "we" in these terms) and the visitors to our website (referred to as "you" or"your" in these terms).

If we do not exercise any right under the terms of this agreement then that shall not constitute a waiver of that right.

13. Applicable law and Jurisdiction
This Website is hosted, controlled and operated from the Republic of South Africa and therefore governed by South African law and, subject to the 'Disputes' clause of these T&C, you and House of Chess shop (PTY) Ltd submit to then on-exclusive jurisdiction of the South African courts.

14. Disclaimer
While House of Chess Shop has endeavored to ensure that all information provided on House of Chess Shop websites is accurate and up to date, House of Chess Shop takes no responsibility for any error or omission relating to this information. To the maximum extent permitted by law, House of Chess Shop will not be liable for any cost, loss or damage suffered by you through your use of House of Chess Shop's websites or House of Chess Shop's failure to provide access to these websites or information updates.

15. Third Parties
To the extent that this website is published or hosted by a third party on our behalf, such third party will not be responsible for the accuracy of its contents.

16. Product availability
1.Stocks of all goods on offer are limited. We shall take all reasonable efforts to ensure that when stock is no longer available, that offers thereof are discontinued. However, should we be unable to fulfill any order placed by you at the advertised price due to stock having sold out, we will notify you and you will be entitled to a refund of the amount paid by you for such product, as explained in more detail in the Refund Policy ("Refund Policy")
2. Lead time is dependent on stock availability. Should we have stock available,orders will be dispatched the same day provided payment is validated / received before 12:00. Every effort is made to effect shipment of your order timeously however unforeseen circumstances may cause delays. Should we be faced with such an occurrence we will contact you via email and provide a revised shipping schedule.

17. Product variations
Please note that although we endeavor to accurately describe and / or depict each product on the Website, some descriptions or photographs may be of a generic nature and not specific to the particular product you wish to buy. However, should you be dissatisfied with the product you receive for any reason, you are entitled to return the product to us for a full refund within 7 days of delivery. Please see our Refund Policy in this regard (which explains how and when you can be refunded, as well as how returns are to be made).
We list all relevant product information as supplied to us by the manufacturer(s). This information is kept as up-to-date as possible. Should there however be a change in a product that has gone unnoticed; we will take the necessary steps to correct the situation. We do take care in order to ensure that all images are as accurate as possible, but it might differ from actual products.

18. Payment Options and Pricing
All prices specified are recommended retail prices. Prices are current at the time of publication and subject to change without notice. All transactions will be processed in South African Rand (ZAR). We reserve the right to change pricing at any time without prior notice. Pricing is valid for web orders only. Telephonic and in-store orders will not necessarily carry the same pricing as advertised online.
We endeavor to offer you competitive prices on current products. Your total order price will only include the price of the purchase. All stock is available ex - Randburg and shipping will be quoted for on request.
We are registered for VAT and you will therefore be charged for VAT.

19. Payment Methods
If payments are made through Electronic Funds Transfer the exact amount must be paid and the payment must be identified by supplying the Invoice number and surname as reference. Fax or e-mail a copy of the transaction as proof of payment.
Note that packages cannot be sent unless we have the name and contact number and full street address of the person/institution that ordered the goods.

Packages will not be posted or delivered unless the full payment due was paid into the account.

20. Refunds
All refunds are at the discretion of our suppliers. Returned parcels will be for the costs of the client.

21. Exchanges
Exchanges will be done at the discretion of House of Chess and at the cost of the customer.

22. Cancellations
Should you for any reason wish to cancel your purchase you will be liable for a 15% handling fee. You must advise us in writing of your cancellation and any such cancellation must be signed by the person who made the original purchase. The goods must be returned to us undamaged in the original packaging within 14 calendar days. Refunds will only be issued if products are returned unopened and with all the packaging, manuals and accessories included.

23. Complaints
All complaints need to include:
1) Your full name
2) Invoice number
3) Product name
4) Product serial number
5) Date of purchase
6) Shipping method (receiving the product)

24. Delivery Policy
When you click to make a purchase with us legal obligations arise and your right to refund of monies paid, are limited by our terms & conditions. You must not make any purchase through this site unless you understand and agree all our terms and conditions. Once payment is made for the purchase, it is deemed that you have read and understood the terms and conditions for such purchase. If you have any queries please contact us before making any purchase for any service or product through this website.

25. Shipping
Standard shipping prices are available in our online store. For other destinations, we will first obtain a quote and forward a price to you when we generate your invoice.

26. Undelivered packages
Occasionally packages are returned to us undelivered. Should this event take place every attempt will be made to contact you to make arrangements for re-shipment.

27. Order processing
Order processing will not begin until we receive a confirmed order and full payment.
